NMSU Alumnus and Former Professor Files Legal Action Over Unlawful Vaccine Mandate

Today, David K. Clements, a former Assistant Professor of consumer protection and business law, announced the filing of a lawsuit against New Mexico State University (NMSU) and its Board of Regents, alleging breach of contract and violation of the New Mexico Unfair Practices Act.

The action stems from his wrongful termination on October 15, 2021, for refusing to comply with NMSU’s COVID-19 experimental vaccine and mask mandate, which he contends violated federal law by lacking informed consent and refusal rights.

“It is difficult to announce this lawsuit in the wake of the Charlie Kirk assassination. He fought for free speech on campuses just like NMSU. Before his life was tragically taken, lives and reputations were destroyed on campuses across America for exercising our First Amendment right to combat forced injections, masking, and invasive testing. For those who held the line against forced injection, many had to endure a six-inch nasal swab shoved up their nose, scraping the back of their throats every week, or else face the loss of their job. It was dehumanizing. I will fight these monsters with everything I have,” Clements stated.

Clements, who taught at NMSU until his dismissal, argues that the mandate disrupted educational services to both students and faculty—services generating $2.6 billion in economic output—and exploited his position as a tenure-track professor to pressure students to get an injection with virtually no scientific data advising them of their risks. The Complaint can be read here.

“The university effectively took bribe money tied to the Higher Education Emergency Relief Fund (HEERF), the Coronavirus Aid, Relief, and Economic Security (CARES) Act, among others. They chose to rake in millions of dollars rather than look out for the health and safety of faculty and students. The statute of limitations for breach of contract is six years. I hope this lawsuit will alert former colleagues and students that were harmed by the jab or denied accommodations, that a university’s greed should not outweigh their rights to receive an education free of coercion. There is still time on the clock for thousands of lawsuits to be filed,” Clements stated.

NMSU is no stranger to controversy. Over the past five years, it has been sued for allegations of hazing, sexual assault, discrimination, retaliation, and wrongful termination. These include an $8 million settlement in June 2023 with former basketball players Deuce Benjamin, Shak Odunewu, and William Benjamin for hazing and sexual assault claims; a $495,000 settlement in March 2024 with former provost Carol Parker for discrimination and retaliation; a $60,000 settlement in February 2024 with former Title IX coordinator Laura Castille for retaliation; a $1 million settlement in July 2025 with a female student alleging mishandling of a sexual assault case; and an undisclosed settlement in August 2025 with former basketball coach Greg Heiar for wrongful termination. These resolutions, totaling over $9.5 million in disclosed amounts, reflect a troubling track record.

Clements’ objection to the mandate’s illegality has been vindicated by recent developments, including the CDC’s 2025 withdrawal of vaccine recommendations for children and pregnant women and Moderna’s requirement for placebo-controlled trials. “As an alumnus and educator, I sought to protect my students and colleagues from potential harm, only to face retaliation,” Clements stated.

The lawsuit seeks reinstatement to a tenured position, compensatory and treble (triple) damages under the UPA for what Clements describes as a willful and unconscionable trade practice. He has requested preservation of all related records to ensure transparency.

What Is ICE Doing With This Israeli Spyware Firm?

The deployment of Paragon’s Graphite spyware was a major scandal in Italy. Earlier this year, the messaging app WhatsApp revealed that 90 journalists and civil society figures had been targeted by the military-grade surveillance tech, which gives “total access” to a victim’s messages. The Italian government admitted to spying on refugee rights activists, and Paragon cancelled its contract with the government almost immediately after the story broke.

Now the same software may be coming to America—and again with an immigration focus. Last week, the U.S. Department of Homeland Security quietly lifted a stop-work order on a $2 million contract that Immigration and Customs Enforcement (ICE) had with Paragon for a “fully configured proprietary solution including license, hardware, warranty, maintenance, and training.”

The deal was first signed by the Biden administration, and it was frozen in October 2024, less than a week after Wired broke the news of the contract. An administration official later insisted to Wired that, rather than reacting to bad publicity, they were reviewing the contract to comply with President Joe Biden’s order to ensure that commercial spyware use by the U.S. government “does not undermine democracy, civil rights and civil liberties.”

The details of that review—or even the contract itself—were never publicly disclosed. But the results are clear: ICE now has a green light to use whatever software Paragon was offering. (Neither Paragon nor ICE responded to requests for comment from The Guardian.)

The Citizen Lab at the University of Toronto, dedicated to researching electronic surveillance, found that Graphite targeted users through a “zero-click exploit.” By adding someone to a WhatsApp group in a certain way, Graphite can force their phones to read an infected PDF file without the user’s input. In other words, a cyberattack can be disguised as a spam text—and works even if victims ignore it.

After discovering the vulnerability with the Citizen Lab’s help, WhatsApp said in a statement that it was “constantly working to stay ahead of threats” and “build new layers of protection into WhatsApp.”

Paragon was co-founded by Ehud Barak, a former Israeli prime minister and general in charge of military intelligence, and Ehud Schneorson, a former head of Unit 8200, the Israeli equivalent of the National Security Agency. Last year, an American private equity firm bought Paragon for $500 million with the intention of merging it into RED Lattice, a firm connected to former U.S. intelligence officials. Paragon has positioned itself as a more ethical alternative to NSO Group, a spyware company similarly run by Unit 8200 veterans.

In 2021, NSO Group suffered a series of scandals after it was revealed that its Pegasus spyware was sold to police states around the world and was possibly used to spy on journalists who were murdered. NSO Group accused the media of running a “vicious and slanderous campaign” and promised to “thoroughly investigate any credible proof of misuse.” The Biden administration hit NSO Group with economic sanctions in response.

Around the time that the Pegasus scandal was breaking, a Paragon executive boasted to Forbes that their company would only deal with customers who “abide by international norms and respect fundamental rights and freedoms.”

Protest as 200-year-old oak trees face chop to save house built in 1980s… with villagers accusing insurance giant of ‘eco-terrorism’

Planted in George III’s reign, the three oaks have stood side by side for more than two centuries.

But now two of the trio – known as the Billingshurst Sisters – could be felled over claims they have damaged a nearby house built in the 1980s.

Insurance giant AXA said their roots have caused cracks and subsidence in the home in the West Sussex village and that the 90ft-high trees must be axed.

The firm has overturned a Tree Preservation Order (TPO) and has sought permission to chop them down from the landowner, Billingshurst Parish Council.

However, furious villagers branded the move ‘eco-terrorism’ and urged the council to oppose the application. Their fate will be decided at a meeting tomorrow.

Campaigners accuse AXA of using a sledgehammer to crack a nut – and failing to properly investigate the subsidence.

They say that shallow foundations or other factors may instead be to blame. More than 2,500 villagers have now signed a petition to save the oaks.

Gabi Barrett, who launched the petition, said the trees are ‘vital to the community’s ecosystem’.

Democrat judge in America’s ‘Muslim capital’ BANS gay pride flags after Islamic outrage

A federal judge has upheld a ban on gay pride flags after a years-long battle by an all-Muslim city council to remove the rainbow because it did not reflect their community’s values.

The court found that Hamtramck, an enclave surrounded by Detroit with a significant Muslim immigrant population, did not violate the US Constitution when it banned the flag from public buildings in 2023.

After a pride flag was flown in the city during Pride Month in 2021 and 2022, the city council said it clashed with the beliefs of some residents, so they voted to allow only five flags to be flown on publicly-owned property.

US District Judge David Lawson, who was appointed by Bill Clinton, dismissed a lawsuit that was brought against the city for its flag restrictions, saying the ban was okay because the policy targeted all private flags.

‘Hamtramck’s refusal to display the Gay Pride flag did not violate the Constitution,’ the judge said.

Hamtramck has a population of around 27,000, and more than 40% of its residents are immigrants. A large proportion of them are Muslim with Yemeni or Bangladeshi descent.

The city is right next to Dearborn, a larger enclave city in the Detroit area that the Wall Street Journal once called ‘America’s Jihad Capital’ in a piece that claimed the city’s leadership supported Hamas and Hezbollah. The publication was widely criticized for the moniker.

The Hamtramck flag ban restricted public property to only display the American flag, Michigan flag, city flag and flags that represent the ‘international character’ of the city’s population.

Businesses and residents are still allowed to fly whatever they want on private property.

The Transgender Castration Cult

In viewing the manifestations of the transgender movement in the past decade, it is evident that it is a cult.  This has been voiced by many, including some transgenders.  It is evident also in the degree of excessive opprobrium and censorship that descends upon anyone, even a physician, disagreeing in the slightest with some of the claims made by adherents of the movement, a typical response of cultists to heresy and to apostates (persons who have detransitioned).  A typical response is, “I’m going to kill JK Rowling with a big hammer.  JK Rowling is very horrible and I hate her so much” and “I’ll slit your f—— throat and f— your newly made neck p—-.”  Additional instances of vicious hatred by transgenders can be seen here.

And they are relentless; despite the obvious scientific evidence that contradicts their views, transgenders and their enablers persist in repeating their mantra (such as the recent Associated Press declaration naming a man as the third-place female athlete of the year).  They even claim that science supports their claims.

Two points differentiate the present-day transgender cult from previous ones.  One is that sexual mutilation in the past was done for the sake of an external ideology, whereas now becoming transgender has become the end in itself — i.e., sexual mutilation has become the ideology, with an extensive supporting network of other transgenders and enablers.  Second, the main focus of castration and mastectomy is on minors, with the recruitment grounds being the internet and schools.

With regard to schools, some supporters of the cult are toxic teachers who conspire against the parents, whom they see as the enemy preventing enlightenment.  They label parents concerned about their children’s welfare as “far-right extremists” for opposing the cult’s power over their children.  They convince students that gender is “assigned,” as if chromosomes did not exist, a Lysenkoist attitude.  These teachers are eager to “educate” their pupils on the teacher’s own sexuality (as if the children cared) rather than simply teach the traditional subjects of math, reading, and writing.  Significantly, some of them use variations of the classic pedophile argument of “Let’s keep this a secret between the two of us.”

Recruiting others to join the cult is done incrementally, by idealizing the transition, minimizing the proposed mutilation, using euphemisms, presenting a role model, and creating confusion about self-identity — in short, engaging in linguistic legerdemain.  Mentally ill individuals and children are particularly vulnerable and are thus targeted.  Block found that high school–aged teenagers who identify as transgender are also more likely than their normal peers to have concurrent mental health conditions including depression, anxiety, attention deficit disorders, and autism.  Wanta and coworkers found transgender patients to have a statistically significant increase in prevalence for all psychiatric diagnoses, while in Finland, Kaltiala-Heino and her coworkers found psychopathology in girls who considered themselves boys.

It appears that mothers of transgender/gender-dysphoric children may have a history of mental illness themselves, although there are scant studies.  Marantz & Coates found that 53% of these mothers met the criteria for Borderline Personality Disorder in contrast to 6% of controls.  The study needs to be replicated and expanded.

Another transgender propaganda pillar is the argument that individuals with gender dysphoria who are exhibiting mental illness symptoms will no longer have symptoms once they go through “gender affirmation” through surgery.  Lewis found that persons who had indeed undergone surgery had a significantly higher risk for depression, anxiety, suicidal ideation, and substance use disorders than those without surgery.  Inversely, a physician who previously advocated puberty-blockers for children in order to alleviate mental health issues carried out a study involving giving puberty-blockers and found that there was no change; however, she refused to publish the results since they went against gender ideology, which was unfortunate, since there is scant research on the subject.

New Look at Old Data Shows COVID Vaccine Dangers Hiding in Plain Sight

Soon after the rollout of COVID-19 vaccines in 2020, top scientific journals published studies declaring the vaccines to be safe and effective — even amid mounting evidence of serious health concerns that eventually led vaccine manufacturers to add warning labels and pull products off the market.

In a new preprint study, scientists from Children’s Health Defense (CHD) and the Brownstone Institute reanalyzed data from those studies. Their analysis found clear health risks linked to the Pfizer and AstraZeneca shots, suggesting the studies “appear biased by design.”

CHD Senior Research Scientist Karl Jablonowski, an author of the preprint, criticized the highly credentialed researchers involved in one of the earlier studies.

“The bedrock, the foundation, the cornerstones, and the pinnacle of the scientific establishment” published an analysis of 46 million adults in England only “to proclaim ‘cardiovascular safety’ where, in fact, there is a veritable cardiovascular catastrophe,” he said.

For their preprint, Jablonowski and his co-researchers performed a safety analysis of the Pfizer and AstraZeneca COVID-19 vaccines using information from several large datasets from the U.K. — the same datasets used as the basis for numerous earlier studies, published in major journals, that concluded the vaccines were safe.

The new analysis confirmed that a significant risk for myocarditis and pericarditis associated with the Pfizer vaccines was evident in those earlier studies. Yet the studies’ results explicitly promoted the “cardiovascular safety” of the shots. The Moderna vaccines were also linked to heart risks.

CHD and Brownstone researchers also found that the risks for cardiovascular disease and death from the AstraZeneca vaccine were significantly higher than those of the Pfizer vaccine.

The AstraZeneca vaccine was a non-mRNA vaccine. It was never authorized or approved in the U.S., but was widely distributed in the U.K. during the early phase of the vaccine rollout. Like other vaccines, the AstraZeneca shot was advertised as safe and effective.

In 2024, AstraZeneca admitted in court documents that its shot could cause deadly blood clotting known as thrombosis with thrombocytopenia syndrome — also referred to as vaccine-induced thrombotic thrombocytopenia. The Johnson & Johnson shot was also linked to the condition.

Months later, AstraZeneca withdrew its vaccine from the market, though it denied the move was linked to the drug’s serious health risks.

At this time, major studies were published — including a highly cited 2024 study in Nature Communications — that promoted the safety of the AstraZeneca vaccine and other COVID-19 shots.

Watch This MSNBC ‘Misinformation’ Reporter Bend Over Backwards to Obscure Charlie Kirk Assassin’s Motives

MSNBC ‘misinformation’ reporter Brandy Zadrozny recently tied herself in knots on television, trying to excuse away the motives for Charlie Kirk’s assassin. The media coverage over the last few days has been awful in general, but this moment deserves some sort of award for blatant dishonesty.

Zadrozny insists that the messages scrawled on the bullets can’t be understood as a symbol of the shooter’s motive, even going so far as to suggest that the shooter might have put those messages there to assign blame to the left.

This is a perfect example of why even NBC no longer wants anything to do with MSNBC, which will soon be rebranded as an independent entity called MSNOW.

The Washington Free Beacon reports:

MSNBC Misinformation Reporter Suggests Kirk Assassin May Have Engraved ‘Hey Fascist’ on Bullet To ‘Set Up’ the Left

MSNBC reporter Brandy Zadrozny suggested Friday that Tyler Robinson, the suspect in Charlie Kirk’s assassination, could have been “trying to set up another ideological enemy for the shooting” by leaving anti-fascist references on the ammunition he used in Wednesday’s shooting.

Authorities revealed at a press conference Friday morning that a shell casing found with the rifle used to assassinate Kirk was engraved with a message that read, “Hey fascist! Catch!” Scrawled on another shell casing were the lyrics from a prominent Italian anti-fascist folk song…

Still, Zadrozny, an award-winning misinformation and internet extremism reporter, said it’s “impossible” to decipher why the alleged assassin decided to end Kirk’s life before offering up a number of theories.

“It’s really hard to tell when you look at what he put on these shell casings, allegedly,” Zadrozny said on MSNBC shortly after Cox announced Robinson’s arrest at a press conference Friday morning. “It’s hard to decipher if he really means them, if he’s trolling, if he’s making fun, if he is trying to set up another ideological enemy for the shooting.”

“It’s just impossible to say,” Zadrozny said.

Researchers Found Unvaccinated Children Healthier Than Vaccinated, Didn’t Publish Findings

Researchers from a large health care system in Michigan found that vaccinated children were more likely to develop a chronic health condition, but never published the findings, according to a copy of the study obtained by The Epoch Times.

Henry Ford Health System, whose employees carried out the study, said it was deficient.

Dr. Marcus Zervos, an infectious disease specialist at the Henry Ford Health, and colleagues studied 18,468 children born between 2000 and 2016 who were enrolled in the health system’s insurance plan, drawing data from medical, clinical, and payer records and supplementing with information from Michigan’s immunization registry.

After 10 years, 57 percent of the vaccinated children had a chronic health condition such as asthma, compared to just 17 percent of the unvaccinated children.

“This study found that exposure to vaccination was independently associated with an overall 2.5-fold increase in the likelihood of developing a chronic health condition, when compared to children unexposed to vaccination,” the authors wrote. “This association was primarily driven by asthma, atopic disease, eczema, autoimmune disease and neurodevelopmental disorders. This suggests that in certain children, exposure to vaccination may increase the likelihood of developing a chronic health condition, particularly for one of these conditions.”

The study was first reported by Aaron Siri, managing partner of Siri & Glimstad LLP, this month in his book, Vaccines, Amen: The Religion of Vaccines.

Before receiving a copy of the study, The Epoch Times asked Zervos and his coauthors for it and questioned why it was never published.

Zervos responded to questions about the study by asking in an email, “Can you tell me what book this appeared in.” When told, he did not respond further.

Co-authors did not return inquiries.

A spokesperson for Henry Ford Health acknowledged that researchers there carried out the study.

“This report was not published because it did not meet the rigorous scientific standards we demand as a premier medical research institution,” a spokesperson for Henry Ford Health told The Epoch Times in an email. “Data has consistently shown vaccinations are a safe and effective way to protect children against potentially life-altering diseases.”

NPR’s Luse: Kirk ‘Said Some Extremely Bigoted Things’ and That’s Why Some on Left Downplay His Death

On Friday’s edition of NPR’s “It’s Been a Minute,” host Brittany Luse stated that Charlie Kirk “said some extremely bigoted things. Because of that, I have seen and heard some folks who are saying something like, this type of violence shouldn’t happen, but I’m not mad that it did happen to this person, meaning Charlie Kirk.”

Luse said, [relevant exchange begins around 12:55] “[L]ooking to the left, Charlie Kirk was undeniably a polarizing figure for his, at times, extreme conservative views. He said some extremely bigoted things. Because of that, I have seen and heard some folks who are saying something like, this type of violence shouldn’t happen, but I’m not mad that it did happen to this person, meaning Charlie Kirk. What would you say to someone who takes that kind of stance in this politically-charged moment?”

Guardian Reporter Abené Clayton responded, “I think that’s a tough one, you know what I mean? Because it’s like, even that comes with its own dangers. You know what I’m saying? I’m a black woman. To me, the things he was saying [were] like, no, this just does not work for me, this is racist, this is trifling. And I also think there’s a little bit of pressure from other folks on the left to see Democratic lawmakers say, like, this person was horrible, this is bad, yes, but also look at what he said. I think that’s what people want, but that’s not super advisable if we’re trying to create an environment of, like, peace, safety, and justice for everyone.”

At the beginning of the show, Luse stated, “America is divided on how to respond to this moment. I have seen some people on the right calling for revenge. I’ve seen some people on the left indifferent or even cheering that this right-wing pundit, who frequently spouted bigoted views, was killed. I’ve also seen people of all political backgrounds fearing for what the shooting and the reaction to it mean for this country’s future.”

Operation “Let’s Grab The Oil”

I don’t know if you remember it, but last year I hypothesized that the Trump administration would focus their attention on a North/South axis of power… and less on an East/West.

Part of this is down to the fact the US Military is stretched globally, and likely no small part comes down to the fact that their ability to project power has for decades been reliant on their naval capabilities. These are now rendered obsolete due to the Russian missiles which can sink them and are unstoppable. All parties know this, though it remains to be seen whether US hubris may ignore it nonetheless.

In any event, focusing on the easy prey — the US own backyard, so to speak. Canada (remember the comments about “Governor Trudeau?”) and the political pressure on Mexico. Then there is the strong allegiance now with Argentina and the pressure being placed on Brazil, the focus on Panama — the canal being all important, of course. All of this is due to a North/South pivot.

So included in this is, of course, Venezuela.

The Escalating Political Showdown: Trump vs. Maduro Over Venezuela’s Black Gold

The relationship between the Donald and Venezuelan President Nicolás Maduro has devolved into one of the most hilarious and contentious international political feuds of recent years, with both leaders engaging in increasingly hostile rhetoric. Of course, it’s all theatre — a sideshow masking the real prize: the struggle over Venezuela’s vast oil reserves, the largest proven reserves in the world.

Why, for example, is Don not blabbing about Costa Rica or Honduras or any other country in the region?

The Bounty That Started It All

Back in March of 2020 the US administration placed a $15 million bounty on Maduro’s head through the DEA’s “Narcotics Rewards Program.” They accused Maduro and other Venezuelan officials of “narco-terrorism” and drug trafficking conspiracy charges. This bounty, along with similar rewards for other Venezuelan officials totaling over $55 million, marked the first time the United States had placed such a substantial price on a sitting head of state.

The US justified this action by claiming that Maduro’s regime had transformed Venezuela into a “criminal enterprise” that facilitated drug trafficking throughout the Western Hemisphere. Secretary of State Mike Pompeo at the time declared that the Venezuelan government had become “one of the most corrupt and destructive forces in the Western Hemisphere.”

In reality, the CIA doesn’t like competition, but anyway…

Maduro’s Counterattack: The Epstein Files Gambit

Maduro’s response was swift and inflammatory. Taking to his official social media accounts, he pointed out who Trump pays allegiance to (Mossad) and suggested a release of the Epstein files. It’s all highly entertaining… except if you’re a Venezuelan, of course, wondering if Trump drops a “big beautiful bomb” on your head.

The Prize: Venezuela’s Oil Wealth

Behind this political theatre lies the true source of tension: Venezuela’s staggering oil reserves. According to OPEC data, Venezuela possesses approximately 303.8 billion barrels of proven oil reserves — roughly 18% of the world’s total. This makes Venezuela’s reserves larger than those of Saudi Arabia (267 billion barrels) and represents more oil than the combined reserves of Iraq, Iran, and Kuwait.

Despite this wealth, Venezuela’s oil production has plummeted from over 3 million barrels per day in the 1990s to barely 800,000 barrels per day by 2020, largely due to mismanagement, corruption, and international sanctions.

The Trump administration’s sanctions effectively cut off Venezuela’s access to US refineries and financial systems, costing the country an estimated $116 billion between 2017 and 2020. So there’s definitely no love lost there.

Social Media War

The conflict has played out extensively on social media platforms, with both leaders using their accounts to escalate tensions. Trump frequently posted on Truth Social about Venezuela, calling Maduro a “dictator” and claiming that “Venezuela’s oil belongs to its people, not to corrupt narco-terrorists.”

Meanwhile, Maduro has used his platforms to portray himself as a victim of “Yankee imperialism,” posting: “They want our oil, our gold, our resources. But the Bolivarian Revolution will never surrender to the gringo empire.”
