House Democrats, Targeting Right-Wing Cable Outlets, Are Assaulting Core Press Freedoms

Not even two months into their reign as the majority party that controls the White House and both houses of Congress, key Democrats have made clear that one of their top priorities is censorship of divergent voices. On Saturday, I detailed how their escalating official campaign to coerce and threaten social media companies into more aggressively censoring views that they dislike — including by summoning social media CEOs to appear before them for the third time in less than five months — is implicating, if not already violating, core First Amendment rights of free speech.

Now they are going further — much further. The same Democratic House Committee that is demanding greater online censorship from social media companies now has its sights set on the removal of conservative cable outlets, including Fox News, from the airwaves.

Media Matters Campaign to Deplatform Fox News Off Cable and Satellite Systems Gains Ground With Democrat Hearing in Congress This Week

The current push is based on accusations by liberals that Fox, Newsmax and OANN broadcast disinformation about the COVID pandemic and the 2020 presidential election. However, Media Matters has a campaign that preceded the current controversies, launched in 2019, called “UnFoxMyCableBox” urging liberals to demand that they stop being charged for Fox News and Fox Business as part of bundled fees.

MMFA boasted their president Angelo Carusone was quoted blasting Fox in Kristof’s column published Feb. 11:

As America debates whether to hold former President Donald Trump accountable for inciting insurrection, what about his co-conspirator Fox News?

…We can’t impeach Fox or put Carlson or Sean Hannity on trial in the Senate, but there are steps we can take — imperfect, inadequate ones, resting on slippery slopes — to create accountability not only for Trump but also for fellow travelers at Fox, OANN, Newsmax and so on.

That can mean pressure on advertisers to avoid underwriting extremists (of any political bent), but the Fox News business model depends not so much on advertising as on cable subscription fees. So a second step is to call on cable companies to drop Fox News from basic cable TV packages.

…“Given all the damage that Fox News has caused and the threat that it remains, they absolutely should unbundle Fox News,” Carusone told me. “It’s not a news channel. It’s a propaganda operation mixed with political smut. If people want that, they should be forced to pay for it the way that they pay for Cinemax.”

“During 2020, Fox News’ caldron of lies and extremism boiled over,” Carusone said. “They made us sicker and put up obstacles to the pandemic response by flooding the airwaves with over 13,150 instances of COVID misinformation. They fomented racial animus and promoted white supremacy as a response to the Black Lives Matter demonstrations. And, in the first two weeks after the election was called for Joe Biden, Fox News laid the groundwork for the attack on the Capitol by challenging the results on 774 individual instances with wild conspiracies and flat-out fabrications.”

House Democrats wrote a letter to cable and satellite providers in advance of this Wednesday’s hearing with this direct question:

“Are you planning to continue carrying Fox News, OANN, and Newsmax on your platform both now and beyond the renewal date? If so, why?”

SENATOR BLUMENTHAL DEMANDS FACEBOOK AND TWITTER CURB VACCINE-SKEPTIC CONVERSATIONS

Connecticut’s Senator Richard Blumenthal, a Democrat, is calling on Facebook and Twitter to act on vaccine skeptic conversations, particularly around pregnant women.

Sen. Blumenthal penned a letter to both Facebook and Twitter. 

“Time and again, Facebook and its peers have moved far too slow in responding to the targeted harassment and promotion of destructive conspiracy theories against women and people of color.

“These mothers, through raising awareness to the vaccine and setting an example for the community, are doing an immense public service and lovingly protecting their infants. They are also acting responsibly,” Blumenthal wrote in the letter to Facebook.

The letter was sent a few days after The Daily Beast published a story on how vaccine skeptics have been sending messages to pregnant women who have gotten the vaccine. In one incident, vaccine skeptics were accused of harassing a medical worker who miscarried a few days after getting a COVID-19 vaccine.

From the letter:

“Such disinformation is clearly coordinated, often through private groups and public pages that scour social media for targets and anecdotes for feeding their campaign. One Instagram account, in operation since December with over 100,000 followers, continues to promote misinformation and misleading anecdotes about vaccine safety and the effectiveness of facemasks. These accounts and groups, on both Facebook and Twitter, have also become a launching point for swarms of believers to prey on mothers to create fear, uncertainty, and doubt. Despite a clear pattern of violating platform policies, these accounts are still active, with large numbers of followers and are easily findable.”

Blumenthal’s concerns seem to stem from the fact that vaccine-skeptic content is still available on social media platforms, despite the Big Tech platforms having new policies against it.

White House working with Facebook and Twitter to tackle anti-vaxxers

The White House has been reaching out to social media companies including Facebook, Twitter and Alphabet Inc’s Google about clamping down on COVID misinformation and getting their help to stop it from going viral, a senior administration official said.

President Joe Biden, who has raced to curb the pandemic since taking office, has made inoculating Americans one of his top priorities and called the move “a wartime effort.” But tackling public fear about taking the vaccine has emerged as a major impediment for the administration.

Since the onset of the pandemic, calls from lawmakers asking the companies to tackle the spread of COVID misinformation on their platforms have grown.

The White House’s direct engagement with the companies to mitigate the challenge has not been previously reported. Biden’s chief of staff Ron Klain has previously said the administration will try to work with Silicon Valley on the issue.

Congress Escalates Pressure on Tech Giants to Censor More, Threatening the First Amendment

For the third time in less than five months, the U.S. Congress has summoned the CEOs of social media companies to appear before them, with the explicit intent to pressure and coerce them to censor more content from their platforms. On March 25, the House Energy and Commerce Committee will interrogate Twitter’s Jack Dorsey, Facebooks’s Mark Zuckerberg and Google’s Sundar Pichai at a hearing which the Committee announced will focus “on misinformation and disinformation plaguing online platforms.”

The Committee’s Chair, Rep. Frank Pallone, Jr. (D-NJ), and the two Chairs of the Subcommittees holding the hearings, Mike Doyle (D-PA) and Jan Schakowsky (D-IL), said in a joint statement that the impetus was “falsehoods about the COVID-19 vaccine” and “debunked claims of election fraud.” They argued that “these online platforms have allowed misinformation to spread, intensifying national crises with real-life, grim consequences for public health and safety,” adding: “This hearing will continue the Committee’s work of holding online platforms accountable for the growing rise of misinformation and disinformation.”

House Democrats have made no secret of their ultimate goal with this hearing: to exert control over the content on these online platforms. “Industry self-regulation has failed,” they said, and therefore “we must begin the work of changing incentives driving social media companies to allow and even promote misinformation and disinformation.” In other words, they intend to use state power to influence and coerce these companies to change which content they do and do not allow to be published.

Democrats’ SAFE TECH Act Could ‘Destroy Most of the Open Web’

A newly-proposed change to Section 230 would introduce legal liability for online platforms and forums for third-party speech. It is being suggested as a way of combating alleged racial and social online injustices. According to critics, however, the bill is ill-conceived and has the potential to transform large parts of the internet for the worse and empower powerful players against smaller competitors.

Section 230 has become a hot topic in the US in recent years. Under this law, which “defined how the Internet works”, platforms adopting a hands-off approach to content moderation cannot be held reliable for harmful or illegal third-party content hosted by them. The protections under the law do not extend to sites which filter users’ submissions and curate content featured on the page. As the Washington Post recounts, the Section was created in the wake of two lawsuits in the 1990s – against Prodigy Services and against CompuServe – coming to similar conclusions.

The provision has come under criticism from both Democratic and Republican legislators, albeit for different reasons. The goal of Republicans, including former president Trump, was to address selective political censorship which has been repeatedly alleged against Silicon Valley online platforms. For example, in December last year, Trump attempted to use his veto power over a proposed defence bill as leverage against the Congress to outright repeal Section 230. 

On the other hand, critics of the law among the Democrats have been blaming social media platforms for being reluctant or slow to remove content deemed as harmful, from hostile communication perceived as harassment to the spread of unreliable information.
