SCOTUS shocked by Biden administration’s view of federal power over states in ER abortion challenge

To convince the Supreme Court that the Biden administration could use federal Medicare funding to force hospitals to perform abortions in violation of Idaho law, Solicitor General Elizabeth Prelogar conceived and gave birth to some unusual arguments Wednesday.

She reached for a 129-year-old precedent that crippled the labor movement for decades, neutered legal obligations to the “unborn child” in the federal law that allegedly requires abortions in certain situations, and didn’t deny a Republican administration could use her rationale to functionally ban abortion and even transgender care nationwide.

Such is the federal government’s interest in ensuring that abortion-minded women can use emergency rooms to terminate pregnancies as conservative states approve new abortion restrictions, or reinstate old ones, under the high court’s reversal of Roe v. Wade in 2022.

Backed by 22 conservative states and sued by the feds, Idaho challenged the Biden administration’s use of the Emergency Medical Treatment and Labor Act as a “super-statute” that overrides its Defense of Life Act, which includes criminal penalties and loss of license, and “turns emergency rooms into a federal enclave where state standards of care do not apply.”

While Prelogar faced skepticism from GOP-appointed justices about the massive expansion of federal power her argument implied, a recurring point of confusion for the whole bench was how much “daylight” stood between EMTALA, designed to stop “patient-dumping,” and Idaho’s law.

The former requires “immediate medical attention” when the health of the individual or “unborn child” would otherwise face “serious jeopardy, serious impairment to bodily functions, or serious dysfunction of bodily organs.” The latter has one health-related abortion exception: “necessary to prevent the death of the pregnant woman.”

Facing dire polling numbers and a lack of left-wing enthusiasm for his “re-election” campaign, Joe Biden is considering taking an extreme measure that should send chills down the spines of any American who values liberty.

During an April 19 broadcast of the Fox Business Show The Bottom Line with Dagen and Duffy, co-host Sean Duffy revealed that the Biden White House told Fox Business that it is considering defying the Constitution and declaring a climate emergency. He then turned to his guest Marc Morano, a former Republican political aide who runs a climate change skeptic website called ClimateDepot.com, and asked him what impact it would have.

Morano cited an NBC News report indicating that if Biden declared a climate emergency, he would have COVID-like emergency powers. This would include the ability to implement the socialist Green New Deal along with up to 130 measures without approval from Congress.

Biden Files Lawsuit Against Gas Station Chain Sheetz the Same Day He Was Mocked for Shuffling Into It

President Joe Biden stopped by a Sheetz location on Wednesday to purchase snacks while on a campaign swing through Pennsylvania on the same day that his Equal Employment Opportunity Commission filed suit against the company and two of its subsidiaries.

Apparently, no one informed the president that his administration considered Sheetz guilty of racial discrimination against applicants. Or someone did tell Biden that, and he just didn’t care.

It might not matter, given the questionable nature of the claim against the company.

“According to the lawsuit, Sheetz has maintained a longstanding practice of screening all job applicants for records of criminal conviction and then denying them employment based on those records,” the EEOC said in a news release (available below).

Those screenings resulted in 14.5 percent of blacks being turned down for jobs, compared with 13.5 percent of “multiracial” applicants, 13 percent of Native Americans, and nearly 8 percent of whites.

The EEOC did not accuse Sheetz of active racism, but said federal law prohibits hiring practices that impact minorities differently than non-minorities.

Even if the criminal background checks are shown to be necessary, an EEOC lawyer said, they could still be unlawful if some other means could be employed that would provide safety without the allegedly discriminatory effects.

The EEOC statement suggested no such alternatives, however.

Biden Admin Sues Sheetz Over ‘Discriminatory’ Hiring Practices Days After He’s Torched Online Over Botched Photo Ops At Other Gas Stations

The Equal Employment Opportunity Commission (EEOC) under the Biden administration took legal action against the Sheetz convenience store and gas station chain on Thursday.

The lawsuit, which comes one day after Biden made a campaign stop at a Sheetz in Pennsylvania, and on the heels of the president’s “scripted” Wawa stop in Philadelphia last week that was widely blasted online, alleges that the Sheetz’s hiring procedures “disproportionately screened out Black, Native American/Alaska Native, and multiracial applicants.”

The EEOC asserted in a press release that the Sheetz chain’s utilization of criminal conviction records as a basis for screening and rejecting applicants constitutes a breach of Title VII’s prohibition on “disparate impact discrimination.”

The EEOC, however, did not allege that the convenience store chain “was motivated by race when making hiring decisions.”

Connecticut! The Place Where Your Government Is Your Best Friend, And Where Your Grocer Is Your Bitter Enemy

From time to time, we are treated to a manufactured fake-news event promoted by the Connecticut Democrat Party in their sworn mission to damage Connecticut’s fragile and failing economy.  This latest event concerning “elevated” grocery store prices led us to a pseudo-intellectual faux economic mission reverberating all over state-run media outlets last week stating that grocery stores of all sizes are “price gouging”, are earning “excessive” profits, and telling us that only state government can fix this problem. During a charade of a press conference held on April 10, Democrat Attorney General William Tong stated: “We won’t stop!” in announcing the inquiry. “We will keep going until we have an understanding of this market.”

First, I had no idea Democrat Attorney General William Tong had degrees in economics and/or accounting and was an expert in grocery store logistics and management.  Secondly, I had no idea that grocery stores large and small were price gouging?  Third, I had no idea that Democrat Attorney General William Tong could instantaneously get his finger around the concept of runaway inflation which has been occurring since Democrat President Biden has taken office in 2021. 

My good friend Tony De Angelo talked about this new Tong investigation at length on this past Tuesday in his weekly segment on the Lee Elci Show 94.9 where Tony pointed out that the 63 page Federal Trade Commission report (“FTC”, “report”) sourcing this press charade, never even once mentioned the term “price gouging” therein. This is even more startling, considering  that the report was engendered by the far-left Biden-appointed Marxist-inspired Commissioner of the FTC, Lina Khan. And as Tony pointed out, who can trust any representation the media-political machine makes in Connecticut, especially when one remembers the debacles of the Scott Franklin-BLM mural vandalism a year ago in Hartford, or much more the lies, graft, and mismanagement of Covid-19.

Biden Regime Proudly Abolishes Title IX – Will Now Force Women to Allow Biological Men in Their Locker Rooms, On their Team Sports and in Their Bathrooms

On Friday, the Biden regime proudly announced that women will be forced to allow men in their locker rooms and bathrooms with a new 1577-page Title IX ruling.

Women will be forced to compete against men.

And women will be forced to accept men on their sports teams.

Women and young girls will be forced to share locker rooms and bathrooms based on gender identity rather than biological sex.

And, as May Mailman, Director of Independent Women’s Law Center, notes, Title IX is not a college law.  This will impact girls as young as those in the Headstart program, geared to children from three to five-years old, those in daycare, and those in Kindergarten through 12th grade.

Young girls everywhere will be subject to the type of sexual exposure allegedly faced by the female athletes forced to share a locker room with trans swimmer Lia Thomas.

Preferred pronouns are also now mandated, and even the single use of the “wrong” pronoun can require discipline.

They believe this is progress.

Title IX is now a thing of the past.

The new rules cement protections for L.G.B.T.Q. students under federal law. Additionally, it reverses Trump-era policies, including one that protects women by dictating how schools should respond to cases of alleged sexual misconduct in K-12 schools and college campuses.

We’ve Blown $1B In Ammo and Navy Secretary says, “Oh well”

We have an industrial base problem and an Administration that has this childish inclination to grab everything off the shelves, rip the boxes open, use some of the contents, throw the partially empty box away, and then lunge for another box on the shelf.

And like a child, they never pause to think where the boxes of stuff come from or ensure new boxes are placed on the vacant shelves.

It’s the mindset of the globalist utopian, just take, never give. They know how to consume, not create or produce. Classic projection – that’s what they accuse of everyone else.

We’re approaching 2 and ½ years of grabbing ordnance off the shelves and not really placing orders with signed contracts. The Biden officials will lecture industry endlessly about the woeful state of the industrial base and then not do two key things. Create more Government owned, Contractor operated plants and place signed orders.

Air Force Plant 44, the singular most important American missile factory, on the southern perimeter of Tucson International Airport, Arizona, where flights are landing daily with illegals and 9,000 illegals a day are streaming up from Nogales has plenty of room for expansion – but no signs of it. Contractors should not be expected to invest in capitalization and expansion when the buying patterns are psychotic which is why many leave the industry.
