COVID Vaccine Injuries Deserve a Day in Court

Some 270 million Americans received at least one COVID-19 vaccine dose. Tens of thousands have since claimed they suffered a COVID vaccine injury, ranging from minor side effects to severe adverse reactions. Around 9,000 of those people have requested compensation through the only legal avenue available to them—the federal government’s Countermeasures Injury Compensation Program (CICP).

To date, the CICP has paid only $30,855 to just eight claimants. Another 1,588 people have had their claims turned down—making for a 98 percent rejection rate. Thousands more have been left waiting with no response. If their claims are also rejected by the program, they have no other means of ever getting compensation.

Typically, someone who’s been injured by a product, medical or otherwise, would be within his rights to sue the manufacturer in a state court. Since the 1980s, federal liability protections prevent people from suing vaccine makers.

But under the decades-old National Vaccine Injury Compensation Program (VICP), people claiming an injury from a non-COVID vaccine are given an alternative to standard civil litigation. Injured patients instead sue the federal government in special vaccine courts, where both sides have lawyers, a special master (judge) decides claims, and people can appeal rejected compensation requests to higher courts. VICP petitioners need only show a preponderance of the evidence that they were injured by a vaccine—a relatively low burden of proof. The VICP approves about half of all claims and pays out $200 million a year (all funded by an excise tax levied on vaccine doses).

The CICP is nothing like this. The program has its origins in a piece of war on terror legislation intended to create liability protections for makers of novel, emergency countermeasures to bioweapon attacks and the like.

Some Service Members Say They Were ‘Coerced’ Into Taking COVID-19 Vaccine: Survey

In an independent survey conducted by the author last fall, 229 individuals currently serving in the U.S. military voluntarily participated by responding to a multitude of questions. Results helped to reveal the difficulties faced by some members of the U.S. Armed Forces who were confronted by Defense Secretary Lloyd Austin’s August 2021 military vaccine mandate.

Part of the anonymous questionnaire addressed the COVID-19 vaccine status of the participating service member, various details about the now-rescinded military vaccine mandate, as well as the deliberate coercion faced by many who opposed it.

All branches of the military as well as enlisted and officer ranks responded to the survey. Survey participants served in the military for an average of about 16 years.

Out of the 229 participants, 169 were active duty service members. Eighty-seven percent, or 199, were unvaccinated against COVID-19. Of the 30 who were vaccinated, only two said they had wanted to do it.

Twenty out of 30 individuals who admitted taking the vaccine claim they were injured by the vaccine. Ninety-three percent of the participants said they know someone they believe has been injured by the COVID-19 vaccine.

The Epoch Times spoke to two of the survey’s participants who used a pseudonym out of concern about reprisals. Both emphasized that their views don’t reflect those of the Department of Defense, or the Department of the Army and Department of the Air Force, respectively.

Biden Cried ‘Book Ban,’ Then Pressured Amazon To Ban His Opponents From World’s Biggest Bookstore

Democrats and their accomplices in the media have expended an awful lot of ink, breath, and energy trying to convince voters that people on the right want to “ban books.”

The leftist firestorm attacks concerned parents working to eradicate pornography and other age-inappropriate books from taxpayer-funded schools and libraries. These works include titles such as All Boys Aren’t Blue, which contains descriptions of rape, incest, and pedophilia, and Gender Queer, which shows graphic depictions of oral sex, masturbation, and homosexual acts.

Democrat activists have come out in full-throated defense of explicit sexual content for children and likened conservatives who oppose it to Nazis who want to burn books. Last month, MSNBC host Joy Reid grilled the co-founder of Moms for Liberty about why parents should have any say in how their tax dollars are used and argued that kids who identify as LGBT “feel seen” by stories about child rape.

One Democrat governor ironically argued that Republican efforts to shield children from age-inappropriate content are “castrating them.” President Joe Biden has also smeared Republicans for “banning books,” and even announced during “pride month” that he would appoint a “book ban coordinator” to make sure schools weren’t removing filth from their shelves.

That’s why it was so ridiculous to learn this week that all while Democrats were shrieking about pornography “book bans,” the Biden White House was actively “pressuring” Amazon, the world’s largest bookseller, to nuke books that raised concerns about experimental Covid-19 shots. It’s a pretty good bet that’s not the only topic the White House pressured Amazon to ban, either.

According to internal documents and emails subpoenaed by Republicans on the House Judiciary Committee, senior Biden official Andy Slavitt, who pressured Facebook to censor speech, was pushing Amazon to ban books disagreeing with Democrat policies.

Because Slavitt didn’t like the “concerning” results that turned up when he searched Amazon books for “vaccines,” he emailed the corporation on March 2, 2021, to ask to whom Biden officials could speak about “the high levels of propaganda and misinformation and disinformation of [sic] Amazon.” The vaccine debate was, and is still, ongoing. But the White House was mad that Amazon didn’t slap a warning from the Centers for Disease Control and Prevention onto books that stepped out of line from the government’s Covid claims.

Lockdowns Were Counterterrorism, Not Public Health 

As previously reported, in the United States, the Covid pandemic response was designed and led by the national security branches of government, not by any public health agency or official

Furthermore, we do not have a public record of what the national security pandemic plan actually stated. 

So what? You might ask. Why should we care if Covid policy was determined by the National Security Council (NSC) instead of the Centers for Disease Control and Prevention (CDC)? What’s so bad about the Federal Emergency Management Agency (FEMA) taking over as lead federal agency for pandemic response, replacing Health and Human Services (HHS)?

National security is about protecting us from threats of war and terrorism

The answer to these questions is, in short, that the national security pandemic response plans, devised under the rubric of biodefense, are aimed at countering bioterrorism attacksThey focus on preventing hostile actors from obtaining bioweapons, surveilling for potential bioweapons use, and developing medical countermeasures. 

According to the World Health Organization, “biological and toxin weapons are either microorganisms like virus, bacteria or fungi, or toxic substances produced by living organisms that are produced and released deliberately to cause disease and death in humans, animals or plants.” 

In the rare event of an actual bioweapons attack – the biodefense strategy can be summarized as quarantine-until-vaccine: keep individuals as isolated from the bioweapon as possible, for as long as necessary, until you have an effective medical countermeasure (medicine/vaccine).

Moderna Scientists Warn mRNA Vaccines Carry Toxicity Risks

The technology used in Moderna’s COVID-19 vaccine carries toxicity risks, scientists with the company said in a new paper.

A major challenge now is how to efficiently de-risk potential toxicities associated with mRNA technology,” the scientists wrote in the paper, which was published by Nature Reviews Drug Discovery on Jan. 23.

The Moderna and Pfizer COVID-19 shots use modified messenger ribonucleic acid (mRNA) technology. The mRNA is delivered by lipid nanoparticles (LNP).

The toxicity risks include “lipid nanoparticle structural components, production methods, route of administration and proteins produced from complexed mRNAs,” the authors of the paper said.

Authors of the paper include Eric Jacquinet and Dimitrios Bitounis, Moderna employees, and Maximillian Rogers, who was working at Moderna when the paper was being done.

Moderna didn’t respond to a request for comment.

The mRNA vaccines have multiple known side effects, including heart inflammation and severe allergic shock. Those may stem from hypersensitivity reactions, which can be elicited by “any LNP-mRNA component” but are most likely triggered by PEGlyated lipid nanoparticles, which is “the most potentially reactogenic component,” the scientists said.

Polyethylene glycol, or PEG, an ingredient in the Pfizer and Moderna COVID-19 vaccines, is known to cause allergic reactions. Outside scientists are divided over the mechanism behind the heart inflammation, while Pfizer has posited that the LNPs are behind the issue.

The new paper drew from prior publications and other data. The authors didn’t carry out any new experiments.

The Covid Booster Cancer Time Bomb

have previously reported on my concern about the rise in stable cancer relapses that I have witnessed in my melanoma clinic. 

None of these patients of mine presented with the classic prodrome of relapse that I had always noticed previously, such as severe depression due to bereavement, divorce or bankruptcy. Indeed the only thing I found they had in common was to have had a recent booster mRNA covid vaccine. I phoned around my colleagues not only in the U.K. but also in Australia to check their experience. In no case did they deny such a link. Indeed, they were equally alarmed at the association between booster vaccines and relapse that they too were witnessing, as well an increase in new cancers, particularly in those below 50 years old. In addition to melanoma these colleagues were also very concerned about a sudden big increase in young patients with colorectal cancer.

Rather than instigating a proper inquiry to investigate this when we raised these concerns, the medical authorities told us all that what we were witnessing was a coincidence, that we had to prove it and above all, not to upset our patients.

Recently the American Cancer Society (ACS) has warned of a surge in new cancer cases in the U.S. this last year of over two million, with many of these cases occurring in younger patients. Indeed, the Chief Scientific Officer of the ACS, William Dahat, announced in addition that cancers were presenting with more aggressive disease and larger tumours at the time of diagnosis, especially in younger patients. Of further interest it noted a difference in the microbiome (the community of micro-organisms such as fungi, bacteria and viruses that exist in a given environment) between patients under 50 compared with those over 50.

This surge mirrors a report from Phinance Technologies of late last year which analysed in detail data from the U.K. Office for National Statistics (ONS) showing that disability and deaths in 2021 and 2022 had increased dramatically in all age groups, but especially in the 15-44 age group. 

The Lancet also published an article before Christmas reporting excess deaths post Covid pandemic to be up by 11-15% over that expected for under-25s and for 25-49 year olds. This is in fact the pattern found in many countries that have published the data. Germany for example has reported excess deaths rising from 7% in 2020 to 24% in 2023.

What makes this all the more surprising is that negative deaths should be the norm after a pandemic as you cannot die twice!

mRNA COVID-19 Vaccines Caused More Deaths Than Saved: Peer-Reviewed Study

With considerably lower efficacy rates, mRNA COVID-19 vaccines cause more deaths than save lives, according to a new study whose researchers called for a “global moratorium” on the shots and “immediate removal” from childhood immunization schedule.

The peer-reviewed study, published in the Cureus journal on Jan. 24, analyzed reports from the initial phase 3 trials of Pfizer and Moderna COVID-19 mRNA vaccines. These trials led to the shots being approved under Emergency Use Authorization (EUA) in the United States. The study also looked into several other research and reviews of the trials. It found that the vaccines had “dramatically lower” efficacy rates than the vaccine companies claimed.

Moreover, based on “conservative assumptions, the estimated harms of the COVID-19 mRNA vaccines greatly outweigh the rewards: for every life saved, there were nearly 14 times more deaths caused by the modified mRNA injections.”

“Given the well-documented SAEs (serious adverse events) and unacceptable harm-to-reward ratio, we urge governments to endorse and enforce a global moratorium on these modified mRNA products until all relevant questions pertaining to causality, residual DNA, and aberrant protein production are answered.”

The authors also recommended an “immediate removal” of the COVID-19 vaccines from the childhood immunization schedule. They pointed out that children were at very low risk from the infection.

It is unethical and unconscionable to administer an experimental vaccine to a child who has a near-zero risk of dying from COVID-19 but a well-established 2.2 percent risk of permanent heart damage based on the best prospective data available.”

BARDA Awards $9.27 Million Contract to Evaluate Oral Pill COVID Vaccine

Biotechnology firm Vaxart, Inc. announced on Jan. 19, 2024 that it received a $9.27 million contract from the U.S. Biomedical Advanced Research and Development Authority (BARDA) to fund preparations for a Phase IIb clinical trial to evaluate the company’s oral pill XXB COVID-19 vaccine candidate. The trial is expected to involve 10,000 participants and will compare Vaxart’s oral pill vaccine candidate to an approved mRNA (messenger ribonucleic acid) biologic.1 2 3 4

“We are very honored to receive this BARDA award, which will support the innovative approach of our oral pill vaccine platform,” said Michael Finney, PhD, Vaxart’s interim chief executive officer. “We believe our oral pill vaccine platform may ultimately hold the promise of revolutionizing how we fight pandemics and how we vaccinate against several infectious diseases.”2 4

According to Vaxart’s chief medical officer, James Cummings, MD, the company’s oral pill vaccine could improve existing COVID biologics in “two important ways”…

First, a thermostable pill vaccine such as Vaxart’s offers the chance to overcome needle-phobia, a documented obstacle to vaccination, and offers the potential to make it easier to vaccinate more people faster than with traditional injected vaccines. Second, our previous research on other vaccine constructs found Vaxart’s oral pill vaccine to be cross-reactive against all tested SARS-CoV-2 variants and to trigger long-lasting immune responses, potentially offering broader, longer protection than the current first-generation vaccines. We believe our vaccine does this by triggering both a systemic and mucosal response.2 4

He Was Arrested for Making a Joke on Facebook. A Jury Just Awarded Him $205,000 in Damages.

On a Friday in March 2020, a dozen or so sheriff’s deputies wearing bulletproof vests descended upon Waylon Bailey’s garage at his home in Forest Hill, Louisiana, with their guns drawn, ordered him onto his knees with his hands “on your fucking head,” and arrested him for a felony punishable by up to 15 years in prison. The SWAT-style raid was provoked by a Facebook post in which Bailey had made a zombie-themed joke about COVID-19. Recognizing the harm inflicted by that flagrantly unconstitutional arrest, a federal jury last week awarded Bailey $205,000 in compensatory and punitive damages.

“I feel vindicated that the jury agreed that my post was satire and that no reasonable police officer should have arrested me for my speech,” Bailey said in a press release from the Institute for Justice, which helped represent him in his lawsuit against the Rapides Parish Sheriff’s Office and Detective Randell Iles, who led the investigation that tarred Bailey as a terrorist based on constitutionally protected speech. “This verdict is a clear signal that the government can’t just arrest someone because the officers didn’t like what they said.”

On March 20, 2020, four days after several California counties issued the nation’s first “stay-at-home” orders in response to an emerging pandemic, Bailey let off some steam with a Facebook post that alluded to the Brad Pitt movie World War Z“RAPIDES PARISH SHERIFFS OFFICE HAVE ISSUED THE ORDER,” he wrote, that “IF DEPUTIES COME INTO CONTACT WITH ‘THE INFECTED,'” they should “SHOOT ON SIGHT.” He added: “Lord have mercy on us all. #Covid9teen #weneedyoubradpitt.”

The Rapides Parish Sheriff’s Office snapped into action, assigning Iles to investigate what he perceived as “an attempt to get someone hurt.” According to a local press report, the authorities were alarmed by “a social media post that promoted false information related to the ongoing COVID-19 pandemic.” In response, “detectives immediately initiated an investigation,” and as a result, Bailey, then 27, was “arrested for terrorism.”

Another news story reported that Bailey “was booked into the Rapides Parish Detention Center on one count of terrorizing.” William Earl Hilton, the sheriff at the time, explained why, saying he wanted to “impress upon everyone that we are all in this together, as well as remind everyone that communicating false information to alarm or cause other serious disruptions to the general public will not be tolerated.”

Bailey’s joke was deemed to pose such a grave and imminent threat that Iles did not bother to obtain an arrest warrant before nabbing him, just a few hours after Bailey’s facetious appeal to Brad Pitt. But in a probable cause affidavit that Iles completed after the arrest, the detective claimed that Bailey had violated a state law against “terrorizing,” defined as “the intentional communication of information that the commission of a crime of violence is imminent or in progress or that a circumstance dangerous to human life exists or is about to exist, with the intent of causing members of the general public to be in sustained fear for their safety; or causing evacuation of a building, a public structure, or a facility of transportation; or causing other serious disruption to the general public.”
