Activist Judges and the Overreach of Judicial Authority: A Case for Sedition and Treason

Executive Summary

The balance of power among the three branches of government is a cornerstone of the United States Constitution.

However, activist judges have increasingly encroached upon executive authority, undermining the separation of powers.

When judges exceed their constitutional authority by obstructing or overturning executive actions without legitimate constitutional grounds, they not only overstep their role but may also commit acts tantamount to treason and sedition.

This essay explores the legal basis for holding such judges accountable, citing relevant laws, cases, and precedents.

The Constitutional Framework

Article II of the U.S. Constitution vests executive power in the President, granting him authority over the administration of federal agencies and the enforcement of laws.

Conversely, Article III establishes the judicial branch, limiting its role to interpreting the law rather than legislating or executing it. The principle of separation of powers is intended to prevent any branch from usurping the functions of another.

James Madison, in The Federalist Papers No. 47, emphasized that “the accumulation of all powers, legislative, executive, and judiciary, in the same hands… may justly be pronounced the very definition of tyranny.” When judges attempt to override executive decisions outside their jurisdiction, they disrupt this balance and engage in judicial tyranny.

The Left’s Judicial Insurrection Against Trump Is a Constitutional Crisis — Here’s Why It Must Be Stopped

Since returning to the White House in January, President Donald Trump has been met with an unprecedented legal onslaught from far-left activist judges and radical groups determined to sabotage his administration at every turn.

These rogue judges—many appointed by Clinton, Obama, and Biden—have launched a relentless legal coup to undermine the will of the American people and prevent Trump from carrying out his constitutional duties.

Appearing on The War Room with Steve Bannon, Josh Hammer, Senior Counsel for the Article III Project, warned that what America is witnessing is no ordinary judicial activism—it’s a full-blown judicial insurrection.

So far this year, President Trump has faced 125 legal challenges in just two months.

The full list of 125 legal challenges remains active and is documented on the Just Security website.

Glorious: Broken MSNBC Host Needs Time Off Because Of ‘Trump Exhaustion’

MSNBC host Lawrence O’Donnell whined to his colleague Rachel Maddow that he is so exhausted from reporting on President Trump that he is taking some time off.

Poor baby.

O’Donnell told Mr Maddow “I know you’ve pledged to cover and be here for the first hundred days of the Trump presidency. I hope you noticed that I did not make that same pledge when you did.”

He added, “This is day 52. I thought it was day 92. It turns out it’s day 52, Rachel, and I’m exhausted at day 52.”

So I’m going to take next week off. And I’m telling you that now cause I know you don’t like it when I just drift away. I’m just taking next week off, then I can come back, and go with you all the way to the 100 days,” O’Donnell whimpered.

Mr Maddow responded, “You have to take care of yourself, you got to pace yourself” as if O’Donnell was about to run back to back marathons or something.

O’Donnell then had the temerity to claim that ” Donald Trump’s brain is broken, badly damaged, as he exhibits every day.”

Who has the broken brain here?

“Can I go with you?” Maddow added.

Now We Know Biden’s Role in the FBI’s Witch Hunt Against Trump

The FBI’s relentless witch hunt against Donald Trump has taken yet another bizarre turn. New revelations show the bureau secretly obtained Trump and Pence’s government phones from Biden’s White House in May 2022, as part of their “investigation.”

“The Biden White House turned over government cellphones belonging to President Donald Trump and former Vice President Mike Pence to the FBI in May 2022 as part of a bureau probe into the aftermath of the 2020 election, tying Trump to that investigation without sufficient predication,” Fox News Digital reports

According to the report, the FBI did not need a warrant to obtain the government phones, but sources told the outlet that “after acquiring the devices, agents began drafting a search warrant to extract the phones’ data.”

“The Biden White House played right along with the FBI’s ‘gotcha’ scheme against Trump,” a source told Fox News Digital. “Biden’s Office of White House Counsel, under the leadership of Dana Remus and Jonathan Su, gave its blessing and accommodation for the FBI to physically obtain Trump and Pence’s phones in early May 2022. Weeks later, the FBI began drafting a search warrant to extract the phones’ data.”

The phones were obtained and entered as evidence as part of the FBI’s original anti-Trump 2020 election investigation, which eventually was taken over by special counsel Jack Smith. That case was known inside the bureau as “Arctic Frost” and was opened April 13, 2022, by anti-Trump former FBI agent Timothy Thibault.

Thibault, according to whistleblowers, broke protocol and played a critical role in opening and advancing the bureau’s original investigation related to the 2020 election, tying Trump to the probe without sufficient predication. Thibault broke protocol by taking action to open the investigation and involve Trump despite being unauthorized to open criminal investigations in his role. Only special agents have the authority to open criminal investigations.

Thibault vowed to make the investigation “prioritized over all others in the Branch” and, at the time, commented that “it frankly took too long for us to open this (investigation),” according to documents reviewed by Fox News Digital.

You can’t make this stuff up. We now know that Biden’s team was all too happy to help the FBI in its latest partisan crusade.

Whistleblower disclosures reviewed by Fox News Digital reveal an aggressive DOJ and FBI investigation targeting Trump and his allies. The disclosures were provided to Senate Judiciary Committee Chairman Chuck Grassley and Senate Subcommittee on Investigations Chairman Ron Johnson, who sent them to Attorney General Pam Bondi and FBI Director Kash Patel on Thursday.

Hillary-Trained Socialists Countrywide

On the day of Donald Trump’s first inauguration in 2017, Hillary Clinton used some of her former staffers and started a nationwide organization to train young socialists to run for positions in state politics, to take those “down ballot races”. To spread communism at the “ground level”. THAT is why we must care.

Her organization is called “Run For Something”, (RFS). RFS solicits, trains, and pays for bringing young progressives (aka, Marxists) into public office. As Wikipedia says,

“Run for Something is a progressive American political organization dedicated to recruiting and supporting young candidates running for down-ballot office. Its mission is to get young progressive candidates from non-traditional backgrounds to run for and win state and local offices, and create a next generation slate of political candidates that will seek higher office” in the years ahead.

I did a deep dig into this years ago, and their training unabashedly includes teaching their young people to lie. A young woman running for Chattanooga TN school board in 2018 had signs all over town claiming that she was a Republican. Fortunately she lost, but she spoke openly about the trained scam, but all units of local governance were not that lucky.

The first year that the young commies were out there running for office, they won over 600 races around the country. They fought against even other Democrats who were considered too “old school Democrat”, i.e., not Leftist enough. Judgeships, School Board seats, city council chairs, and even state legislatures were filled with Hillary’s young Communists.

NPR Complains Trump Budget Cuts Hurt a Kansas College, Turns Out It’s a “Dropout Factory” with a Prior 9% Graduation Rate

It should come as no surprise that National Public Radio has been propagandizing its aging leftist listeners against the Trump budget cuts, highlighting supposed abuses.

One such recent example is a profile of the Women’s Basketball team at Haskell University, a small college for Native Americans in Kansas. The coverage of the controversy complains about an alleged quarter of its staff who are laid off because they are probationary employees of the federal government.

NPR’s coverage of the University highlights its positives, but omits key details and context that would give its readers a better perspective on why these cuts might be in the best interests of taxpayers and even the students involved.

A lawsuit has been filed to force Trump to fund the Indian college. The federal government funds the college as part of an 1884 Indian treaty.

The case is styled as Pueblo of Isleta et. al v. Secretary of the Department of the Interior, et. al, case number 1:25-cv-00696-AHA  . The student plaintiffs are Ella Bowen, Kaiya Brown, Danielle Ledesma, Victor Organista, and Aiyanna Tanyan. Their attorney is Matthew Lee Campbell of the Native American Rights Fund, out of Boulder, Colorado. Two other attorneys have applied to enter the case Pro Hac Vice: Jacqueline De Leon and Malia Gesuale. The case has been assigned to federal Judge Amir Ali, a 2024 Biden appointee.

The complaint primarily concerns the fact that the various Indian tribes were not consulted prior to the budget cuts.

NPR makes it seem like this is another step in the trail of tears for America’s native population.

“That it would be affected by these executive actions and cuts in budgets, you know, add it to the list of broken promises,” said Bo Schneider, a member of the Fort Peck Assiniboine and Sioux Tribes, to National Public Radio.

The 54 page, 8 count legal complaint, which includes four students as plaintiffs, complains that they aren’t able to make progress towards their degrees.

However, public records and data suggest that few were likely to ever graduate, because the college has such an awful academic record that 9-30% of the students are likely to graduate.

MAGA Florida Homeowner Fined $60K for Massive Trump Banners Beats County in Lawsuit

A MAGA-loving Florida homeowner won a lawsuit against Walton County this month after racking up more than $60,000 in unpaid fines for hanging massive pro-Trump banners for several years on the side of his house on County Road 30A.

Walton County code compliance officials told homeowner Marvin Peavy that his various Trump banners violate the scenic corridor code after someone filed a complaint, WJHG reported. Peavy refused to take his banners down, and the county began fining him $50 daily for his displays. Peavy argued the county code violated his First Amendment rights.

“Their laws cannot supersede my First Amendment right, so they came after my constitutional rights which they cannot do. It woke me up as a patriot,” Peavy told NewsChannel 7 in November. “I’m very happy that they came after me and I woke up, I’ve got great lawyers. We feel very good about what’s going on. The U.S. Supreme Court has already ruled that you can have signs on your home. They cannot do anything about it.”

Projection: ‘Mad’ Maxine Waters Claims Trump ‘Working Towards A Civil War’

“This president is putting us in a position where hungry people are going to be on the street. Where nonprofits, who were waiting for their checks, are not gonna get them. Where seniors waiting for their Social Security check, will not get it. Where poor families with children will not get what they believe the government has agreed to do,” Waters told the media in Virginia, according to The Hill.

“And so when that happens, what does Trump expect? Oh, I believe he expects violence. I believe he expects confrontation. I believe he’s working towards a civil war,” she added.

Waters’ remark comes amid a dangerous swatting campaign being waged against conservative commentators and radical anti-Elon Musk activists attacking Tesla cars and dealerships.

Meanwhile, prominent Democrats including Waters herself, have been inciting violence by repeatedly claiming Trump and Musk are “Nazis” who must be stopped lest the entire nation be destroyed.

Judicial Insurrection: Radical Leftist Judges Wage All-Out War Against President Trump — 119 Legal Challenges in Just Two Months, MORE THAN DOUBLE Any U.S. President in History

Since returning to the White House in January, President Donald J. Trump has been met with an unprecedented legal onslaught from far-left activist judges and groups determined to sabotage his administration at every turn.

Appearing on The War Room with Steve Bannon, Josh Hammer, Senior Counsel for the Article III Project, warned that what America is witnessing is not just judicial activism—it’s an outright judicial insurrection.

This is similar to how the communist left attacked him using a cadre of radical activist judges his first time in office.

After nearly two months in office, these radical extremist judges continue to wreak havoc on the Trump administration and the country.

So far, the Supreme Court has failed to shut down this lawlessness by these far-left activists.

Attorney Josh Hammer: “Let me just lay the scene briefly here. What we’re seeing is not just judicial activism, Steve. I used the words very carefully there. I mean, this is a full-on judicial insurrection, going back to the very first days of this administration in power.

By the way, those of us with a long enough memory to remember the first Trump administration. This is nothing new.

The first Trump administration from 2017 to 2021, faced, by my count, I believe, it was 65 so-called nationwide injunctions, which, by the way, is more than the first 44 presidents of the United States combined, literally in all of American history, faced there.

They basically picked up in January, just last month, as if they hadn’t lost a beat over the past four years. Whether it’s a judge in Washington State or Ohio or Washington DC or Florida, or Hawaii, the notion that you can issue a TRO, a temporary restraining order, and thereby try to bring a federal executive branch policy and executive order to halt. It’s completely anathema. It’s bat-crap crazy. That’s not how the separation of powers works.”

On Wednesday, soulless activist Judge Tanya Chutkan ruled that state attorneys general can access information about DOGE employees working to cut waste and fraud in government. Chutkan put a target on their backs so violent leftists could pursue them on the streets of America. What a complete loon.
