Poland Prepares New Hate-Speech Law: 3 Years In Prison For Insulting LGBT People

Poland, once a bastion of conservatism, is radically shifting gears under the new left-liberal government with a new “hate speech” law that could see offenders imprisoned for up to three years for “offensive” content against LGBT people.

The left had already been pushing for stricter speech controls before the coalition government formed, and since it won power, the left is now making good on its promises. On Wednesday, the Polish Ministry of Justice published a draft amendment to the penal code regarding hate speech on the website of the Government Legislation Center.

The new draft law is looking to expand classifications regarding hate speech to include age, disability, gender, sexual orientation and gender identity, according to Polish news outlet DoRzeczy.

In a strong stand against government plans to penalize what it calls “hate speech,” Poland’s Confederation party asserts the need for free and unrestricted public discourse

“The introduction of the proposed solutions will ensure enhanced and full criminal law protection against the use of violence or unlawful threats, incitement to hatred, insults and violations of bodily integrity due to the disability, age, gender, sexual orientation or gender identity of the injured party,” reads the draft.

The draft also threatens up to five years in prison for “threats.”

However, even for “insults,” which are loosely defined, penalties could be extremely harsh under the new draft law.

Provisions regarding gender, sexual orientation and gender identity have been added to article 256, which covers incitement to hated and in article 257 regarding insults.

Now, under these new rules, “insults” against sexual orientation or gender identity will be punishable by up to three years in prison.

Police Scotland to Stop Investigating Crimes While Enforcing New Anti-Free Speech Law

As it prepares to investigate every report it receives under the new Hate Crime Act, Police Scotland admits that a separate plan to stop investigating crimes like theft and criminal damage will help criminals.

A Police Scotland pilot in Aberdeen which was deemed a “success” means “more than 24,000 offences a year will no longer be allocated to a front-line officer.”

The body refused to tell the Telegraph which offences would not be investigated, asserting that it would provide criminals with a “tactical advantage”.

“Police Scotland refused to release the data, claiming that admitting which crimes the policy could apply to would risk handing “those with criminal intent” the opportunity to “plan and orchestrate their criminal activities with the aim to avoid detection,” reports the newspaper.

However, Chief Constable Jo Farrell told a meeting of the Scottish Police Authority that some forms of theft and criminal damage would not be investigated.

The new policy is designed to free up time for officers to focus on other crimes.

Scottish Police Trained To Target Actors And Comedians Under Hate Crime Laws

Police in Scotland are being trained to target actors and comedians under new hate crime laws set to be activated next month, reports The Herald, citing leaked police documents.

Training materials obtained by the outlet state that content deemed to be “threatening and abusive” under the Hate Crime and Public Order can be communicated “through public performance of a play.”

A slide from the leaked training material titled “stirring up hatred” also lists ‘protected’ characteristics including age, disability, religion, sexual orientation and transgender identity.

In other words, under First Minister Humza Yousaf’s new law, any performer who for example ‘misgenders’ trans people, jokes about race or religion, or even criticises migrants can potentially be prosecuted.

The training material further states that even those forwarding or sharing material deemed to be ‘hateful’ can also be targeted under the law.

It states “The different ways in which a person may communicate material to another person are by: displaying, publishing or distributing the material, for example on a sign, on the internet through websites, blogs, podcasts, social media etc., either directly, or by forwarding or repeating material that originates from a third party, through printed media such as magazine publications or leaflets.”

J.K. Rowling Vows to Continue “Calling a Man a Man” in Defiance of “Ludicrous” New Hate Crime Laws

J.K. Rowling has vowed to continue “calling a man a man” in defiance of controversial new SNP hate crime laws, which she branded “ludicrous”. The Telegraph has more.

The Harry Potter author said she would not delete her social media posts, in which she has regularly argued that trans women are not women, to avoid being taken to court “under this ludicrous law”.

She said she would instead “do some more accurate sexing” after the legislation takes effect at the start of next month, despite predictions that LGBT campaigners plan to use it to target her. Rowling lives in Edinburgh.

Humza Yousaf oversaw the passage of the Hate Crime and Public Order (Scotland) Act at Holyrood in 2021, when he was Justice Secretary in Nicola Sturgeon’s Government.

It will come into force on April 1st after Police Scotland said it needed time for “training, guidance and communications planning”.

The legislation creates a criminal offence of “stirring up of hatred”, expanding on a similar offence based on racist abuse that has been on the statute book for decades.

Make Speech Free Again

Winston Churchill said, “Everyone is in favor of free speech. Hardly a day passes without its being extolled, but some people’s idea of it is that they are free to say what they like, but if anyone says anything back, that is an outrage.”

What has made America great are our basic tenets of individual rights which cannot be taken away by the state, and foremost among these is freedom of speech. Authoritarian regimes always try to control speech. This was true in the Soviet Union, and it is true today in Russia, China and Venezuela.

Mr. Scott Kalb, an elected Democrat on the BET, the town’s finance board, has been circulating a letter in support of the newly proposed Greenwich Speech Police, known by the rather malaprop name of The Greenwich Antisemitism and Anti-Hate Task Force (GAATF?). Presumably they mean the Greenwich Task Force to Combat Hate and Antisemitism. Of course, to deal with actual hate crime we already have the Greenwich Police Department, the State Police and the FBI, so the GAATF is not about crime, it’s about speech, and in this case, it’s about speech Mr. Kalb, Mr. Camillo and members of GAATF don’t like, sometimes found in these pages.

Speech suppression involves deciding what is hateful, and then banning it either directly or surreptitiously with indirect political pressure, “shadow bans” and online “blocking,” as we see in the case before the Supreme Court.

Mr. Kalb in his letter misleadingly cites the rise in antisemitic acts since the October 7th massacre of Israelis as a reason for instituting what amounts to a Speech Tribunal whose role must be to decide what is hate speech and what is antisemitism. Mr. Kalb and the DTC have been at it before, trying to stifle dissent by claiming that identifying Mr. Kalb as a “globalist” was antisemitic, though even the ADL acknowledges that “In some cases, its use [“globalist”] is more or less mainstream.”

Such accusations are invariably attempts to silence opposition.

GAATF is a continuation of Mr. Kalb and the DTC’s ongoing attempts to cover and deflect the actual hate and antisemitism coming from of the left, the evidence of which is incontrovertible and has led to the resignation of college presidents. But the hate from the left is also palpable, and unlike the occasional, laughable Nazi march, the hate from the left is massive and spreading.

Trudeau Demands Life In Prison For Speech Crimes

To protect children from sexual exploitation, Canada must pass the Online Harms Act, says Prime Minister Justin Trudeau’s government. “I am the parent of two young boys,” said Justice Minister Arif Virani. “I will do whatever I can to ensure their digital world is as safe as the neighborhood we live in. Children are vulnerable online. They need to be protected from online sexual exploitation, hate, and cyberbullying.”

But Virani’s bill is totally unnecessary to protect children. Its real goal is to allow judges to sentence adults to prison for life for things they’ve said and for up to a year for crimes they haven’t committed but that the government fears they might commit in the future.

As such, Trudeau and Virani’s Online Harms Act (Bill C-63) is the most shocking of all the totalitarian, illiberal, and anti-Enlightenment pieces of legislation that have been introduced in the Western world in decades.

The Liberal government’s censorship legislation, when considered in the context of Trudeau’s sweeping abuse of governmental powers during and after the Covid pandemic and new subsidies for government propaganda, sets a new watermark in rising totalitarianism in Western societies.

In an unusually long statement in response to a series of questions asked by Public, the Trudeau government’s “Canadian Heritage” department, which regulates the media, tried to ease our concerns.  “Bill C-63 is meant to bolster the rights of Canadians to express their thoughts and opinions,” said the anonymous official, “by creating a safer and more inclusive online space.”

But the government spokesperson went on to confirm the shocking truth about the legislation, which is that it would put people in prison for life for things they’ve said, specifically, “advocating genocide.”

“Bill C-63 would increase the maximum penalty specifically for advocating genocide from 5 years to life imprisonment,” said an unnamed spokesperson for the Canadian government, “and from 2 years to 5 years, on indictment, for the willful promotion of hatred (section 319 of the Criminal Code)” [emphasis added]

This means someone who writes something that a government official decides is “advocating genocide” will face a longer maximum sentence than someone who rapes a child.

And what might count as “advocating genocide”? Today, there are prominent politicians around the world who say that supporters of Israel are advocating the genocide of the Palestinian people and that supporters of Hamas are advocating genocide against Jewish people. Imagine if they were in power. Under Trudeau’s legislation, would they not be able to send their political enemies to prison for life?

The freedom to say whatever we want is one of the most fundamental rights in a free society.  If we are not free to speak up, it is is just a matter of time before all of our other rights are taken away as well.  So it should deeply alarm all of us that free speech is under attack like never before.  Much of the population has become convinced that “hate speech” is a special class of speech that does not deserve protection.  Of course in practice “hate speech” ends up being whatever forms of expression that the leftist elite hate.  That is why “hate speech” laws are always written so vaguely.  That way they can be used to go after whoever the leftist elite feel like going after at the time.

It is not always easy to have a society where people are allowed to say whatever they want.  People say things all the time that deeply, deeply offend me.  And there are some that have said things about me that are tremendously hateful and untrue.

But if we are going to have a free society, people have got to be free to say whatever they want.  So we should never support freedom of speech being taken away from anyone, because once we start going down that slippery slope it is just a matter of time before they come after our freedom to say what we want.

That is why what is happening in the state of Washington is so alarming.  A new law would allow private individuals to collect up to $2,000 every time they report someone to the new “hate crimes and bias incidents hotline”…

That is why what is happening in the state of Washington is so alarming.  A new law would allow private individuals to collect up to $2,000 every time they report someone to the new “hate crimes and bias incidents hotline”…

Senate Bill 5427, after it is signed into law, would allow private individuals (note: this is not limited to American citizens) to report “bias incidents*” (see definition below) to the State Attorney General’s Office, with the possibility of receiving up to $2,000 of taxpayers money for this noncriminal incident. The bill was very clear: this is a non-crime which they will then forward to local law enforcement to investigate. What’s to investigate? No crime, no investigation.

The Progressives & Marxists who sponsored this bill say it is intended to help “victims of hate crimes” before a crime even happens. Say what? In reality, SB 5427 would create a “tattletale hotline,” undermine legitimate criminal investigations, and freeze, not just chill, speech & the press in Washington State. People will stop talking to others and writing to others except very close friends & relatives, for fear a greedy “Karen” will report them to Washington’s version of the Gestapo.

This is crazy.

Online harms act makes hate speech akin to murder

When I was a kid, we used to say that, “Sticks and stones may break my bones but words will never hurt.” Nowadays, offensive speech is considered violence. Silence is violence. And those whose words are deemed by the state to be most egregious will be treated like serial killers.

“All of us expect to be safe in our homes, in our neighbourhoods and in our communities,” said Justice Minister Arif Virani, after tabling Bill C-63, the online harms act, in the House of Commons on Monday. “We should be able to expect the same kind of safety in our online communities.”

Except many Canadians don’t feel safe in their communities anymore. Last summer, Statistics Canada reported that the police-reported crime rate in 2022 had increased by five per cent compared to a year earlier. The homicide rate rose for the fourth consecutive year, reaching its highest level since 1992.

Rather than focusing on the type of crime that puts Canadians’ property and physical safety at risk — the “sticks and stones,” if you will — the government has chosen to focus on the words being transmitted to our smartphones and laptops.

To accomplish this, the Liberals propose burdening “social media” platforms with heavy-handed regulations; creating a giant censorship bureaucracy to force compliance; and re-empowering kangaroo courts to persecute people for thought crimes.

Bill C-63 establishes a new digital safety commission, digital safety ombudsperson and digital safety office (to assist the commission and ombudsman), which will be responsible for ensuring revenge porn and child pornography are taken offline within 24 hours. (Though child porn is already taken seriously by social media platforms and, if history is any indication, it won’t be long before the new bureaucracy’s mission expands).

The Irish Should Reject The New ‘Hate Speech’ Bill

The Republic of Ireland could soon become one of the worst violators of the human right to free speech in the Western world. Despite the government claiming to espouse liberal ideas, the looming Incitement to Violence or Hatred and Hate Offences Bill would usher in a dangerous new standard for state-driven censorship. The expression or possession of content or even ideas deemed “hateful” would be illegal under the law, with serious implications for everyday people simply seeking to live according to their convictions.  

The Irish need only look to the case of Finnish member of parliament Päivi Räsänen — criminally prosecuted for over four years for a Bible-verse tweet, to recognise the suffocating impact “hate speech” laws engender. Finnish state prosecutors are pushing her case into its fifth year with an appeal to the country’s supreme court, making no attempt to hide their insatiable quest to silence and sanction the parliamentarian for her peaceful expression of Christian conviction. 

Räsänen’s “crime” consisted of sharing her Christian position on marriage and sexuality in a 2019 Twitter post. When her church decided to officially sponsor a Helsinki “Pride” event, she expressed an objection in light of Biblical teaching, posting a verse from the New Testament book of Romans. Lengthy police interrogations followed by criminal prosecution ensued, absurdly under the section of the Finnish criminal code titled “war crimes and crimes against humanity”.  

Räsänen was dealt three criminal charges, carrying a potential prison sentence of two years, for the tweet, in addition to her comments on a 2019 radio debate and in a church pamphlet she had authored nearly 20 years before. Lutheran Bishop Juhana Pohjola was charged alongside her for publishing the booklet for his congregation. 

Räsänen and Pohjola were twice unanimously acquitted of all charges, but with the pending supreme court appeal, it’s clear that free speech in Finland hangs very much in the balance. The prosecution of individuals in the public eye has a particularly repressive effect — few and far between will be the brave person willing to speak their mind when the state, utilising near limitless resources, makes clear its tireless pursuit of censorship.  

Such is the reality increasingly facing us in the West who dare to voice our beliefs in the public square. While “hate speech” laws are pervasive throughout Europe, with the proposed new law, Ireland is setting a new low bar for censorship. Notably, the draft bill goes so far as to include a sentence of up to five years in prison for the mere possession of “hateful” material.  

Not content with its existing array of free speech restrictions, the government has based the necessity of the new law on the need to counter rising violence in Ireland, following a surge of incidents largely tied to tensions over immigration. The argument is that restricting speech somehow increases safety on the streets—but history has shown no proof of this. What it has shown is that censorship is the preferred answer to any problem the state faces. It’s easier for those in power to silence dissent, than to deal with the problems plaguing their societies.  

The thought of Irish police raiding homes to seize materials, including books and even something as ridiculous as memes on phones, recalls some of the darker episodes of the past century.
